Access Rights

Any request to exercise access rights has to be made in written form. In Horizon 2020, granting a license does not include at the same time the right of also grant sub-licences. The participants need to identify the background needed for carrying out the project in writing. A request for access can be made up to one year after the end of the project unless otherwise agreed between the participants.

Access Rights for project implementation: access rights to results have to be granted to the project participants royalty-free. The same holds true for access rights to background unless this has been otherwise agreed before the grant agreement has been concluded.

Access Rights for exploitation: access rights to results and to background have to be given to the participants at fair and reasonable conditions, if they are needed for the use of a participant’s own results.

The definition of "needed" is an effective filter for the adequate protection of the participants. "Needed" means, that the access to a partner’s knowledge has to be essential to accomplish the respective exploitation measure.

Further obligations on the granting of royalty-free access rights to background for exploitation exist in areas such as security-related research or training and mobility actions.

Royalty-free access rights are in certain cases (use in political, non-commercial context) also granted to the European Union as well as to member states when the research is carried out within Societal Challenge 7 “Secure societies”.
