Within the Seventh Framework Programme model employment contracts are available for German host institutions, which are about to recruit Marie Curie fellows through Initial Training Networks (ITN), Intra-European Fellowships (IEF) and International Outgoing Fellowships (IOF). In addition to that, a model for a partnership agreement between the German host institution and the partner institution in the third country is available.
Furthermore, a glossary as well as an English reading version of the model employment contracts have been compiled.
The model contracts provide support for the composition of Marie Curie-specific employment contracts by considering the provisions of the European Commission for the funding arrangements as well as the legal requirements of the host institution. However, using the model contract or single parts of the text requires in any case an obligatory juridical assessment by the recruiting institution.
The model contracts are set up as employment contracts according to BGB §611. The Working Group "MC-model contracts" does not recommend the use of employment contracts according to TV-L/TVöD since the cost allowances in the Marie Curie Programme (Specific Programme People) usually cannot be replicated correctly by TV-L/TVöD contracts. Depending on the status of the Marie Curie fellow (doctoral/post-doctoral fellow), there might occur a financial gap or surplus respectively (see Marie Curie- salary comparison).
